Changes to your public-sector pension plan

The legislative amendments to the Pension Plan of Certain Judges of Québec (PPCJQ) (Part V.1 of the Courts of Justice Act) concern individuals who held office as a presiding justice of the peace on 31 December 2016 or who were nominated after that date, but before 7 December 2017.

The key amendments mainly concern:

An extension granted for transferring years of service accrued under the PPMP as presiding justices of the peace to the PPCJQ

Persons concerned: Presiding justices of the peace who held office on 31 December 2016

A 180-day extension after 18 September 2019 has been granted to presiding justices of the peace who were contributing to the PPMP on 31 December 2016. This makes it possible for them to apply to have years of service accrued under the PPMP as a presiding justice of the peace after 29 June 2004 transferred to the PPCJQ.

Retraite Québec must receive the transfer application no later than 16 March 2020, that is, 180 days after 18 September 2019.

The extension also applies to transfer applications filed by the surviving spouse, provided the death occurred before the expiry of the deadline for applying.

This change is in accordance with the legislative amendments assented to on 7 December 2017, which set 1 September 2018 as the deadline for filing a transfer application.

Transferring to the PPCJQ the value of years of service accrued under the PPMP for persons who did not hold office as a presiding justice of the peace

Persons concerned: Presiding justices of the peace who held office on 31 December 2016 or who were nominated after that date, but before 7 December 2017

Presiding justices of the peace who were contributing to the PPMPon 31 December 2016 and who are applying for a transfer to the PPCJQ the years of service accrued under the PPMP during which they held office, as well as those who were nominated after 31 December 2016, but before 7 December 2017, can request to have the value of years of service accrued under the PPMP transferred to the PPCJQ, for periods during which they did not hold office as a presiding justice of the peace.

Retraite Québec must receive the transfer application no later than 16 March 2020, that is, 180 days after 18 September 2019. In addition, for presiding justices of the peace who were contributing to the PPMP on 31 December 2016, an application for the transfer of years of service accrued under the PPMP as a presiding justice of the peace must be filed before or at the same time as the date of the application for the transfer of the value of years of service accrued under the PPMP for persons who did not hold office as a presiding justice of the peace.

The transfer gives entitlement to a pension credit This link will open in a new window. payable at age 65, the amount of which is added to your pension under the PPCJQ.

It is now possible to apply to have the value of years of service accrued under pension plans other than the PPMP transferred to the PPCJQ

Presiding justices of the peace who were contributing to the PPMPon 31 December 2016 and who are applying for a transfer to the PPCJQ the years of service accrued under the PPMP during which they held office, as well as those who were nominated after 31 December 2016, but before 7 December 2017, can request to have the value of years of service accrued under a pension plan other than the PPMP transferred to the PPCJQ.

If you are retired when you apply for a transfer, Retraite Québec will review the benefits payables to you for the six months prior to your application to take into account the transfer.
